Voorwaarden verkoop

Beste Client en/of deelnemer aan een van mijn programma’s,
In deze algemene voorwaarden hebben we vastgelegd wat jouw en mijn rechten en plichten zijn. Als je deelneemt aan een van mijn programma’s en er is een probleem waarover je niets kan vinden in deze algemene voorwaarden, neem je dan even contact met ons op? Dan zoeken we samen een oplossing.
Als je in deze tekst een van deze woorden ziet staan, dan wordt daar formeel dit mee bedoeld:

Ik: E.M. Bosma in m’n bedrijf ElsBosma.com, ingeschreven bij de Kamer van Koophandel onder nummer 70186588, en gebruiker van deze algemene voorwaarden.
Jij: de natuurlijke- of rechtspersoon die een programma volgt of andere overeenkomst aangaat met mij.

Programma: Alle vormen van informatie-overdracht van mij aan jou, zowel online als offline, in groepsverband of individueel. Deze algemene voorwaarden zijn van toepassing op alle aanbiedingen, offertes en overeenkomsten en overige rechtsbetrekkingen tussen jou en mij.
Aanbod
Ik doe een aanbod op de website, via webinars en op andere manieren. Aanbiedingen zijn geldig voor de tijd die in het aanbod wordt aangegeven, daarna niet meer.
Overeenkomst
De overeenkomst komt tot stand wanneer je akkoord gaat met een aanbieding of offerte, als je de overeengekomen vergoeding betaald hebt. Ik neem voor deze overeenkomst een inspanningsverplichting op me, maar geef geen garantie over het bereiken van het beoogde resultaat. Als het nodig is, mag ik de overeenkomst (mede) door een derde laten uitvoeren. Dat is nog nooit voorgekomen, het staat hier dus puur voor noodgevallen. Als het nodig is om de overeenkomst te veranderen, geef ik dat op tijd en vóór ingang van de verandering door.
Programma’s
Je kunt tegen betaling een (online) programma volgen bij me. Toegang tot het programma is persoonlijk. Dus je mag je inloggegevens en de materialen uit het programma niet met anderen delen. Ook live sessies zijn alleen voor jou toegankelijk.
Je kunt pas na betaling deelnemen aan een programma. Je moet een internetverbinding hebben om het programma te kunnen volgen. Ik ben niet aansprakelijk voor schade of gemiste programma-onderdelen doordat je niet de juiste apparatuur of internetverbinding hebt. Het programma kan gevolgd worden op de momenten die je zelf kiest. Als je 1op1-begeleiding bent overeengekomen, spreken jij en ik samen de data af voor de begeleiding.
Vergoeding en betaling
Betaling moet gedaan zijn voordat het programma start. Ik e-mail je de factuur.
Ontbindingsrecht / Annuleringsperiode
Als klant heb je het recht de overeenkomst zonder opgaaf van reden te ontbinden binnen 14 dagen na inschrijving, echter wel voordat er een Life sessie heeft plaatsgevonden. In het geval van een dienst of een levering van digitale inhoud die niet op een materiële drager wordt geleverd, binnen 14 dagen na het sluiten van de overeenkomst. Binnen deze periode ontvang je je investering volledig terug. Na de termijn van 14 dagen is het niet mogelijk om je deelname te annuleren en daarbij je investering terug te ontvangen. Je komt hier expliciet overeen dat artikel 7:408 lid 1 van het BW niet van toepassing is en dat tussentijdse opzegging niet mogelijk is.
Procedure van annuleren
Indien je gebruik wenst te maken van het ontbindingsrecht dien je dit binnen de bedenktijd (echter in ieder geval voor de Life sessie, als dat van toepassing is) per e- mail aan Els Bosma via hello@elsbosma.com te vermelden. Je ontvangt hierop een bevestiging per e-mail van ontvangst. Hierna zal je toegang tot het cursusmateriaal en de online community worden geannuleerd en alle geplande mails rondom de training worden niet meer verzonden. Je ontvangt na annulering een creditfactuur voor je eigen administratie en binnen veertien dagen ontvang je je investering terug op het gewenste bankrekeningnummer.

Afspraak verzetten
Het kan natuurlijk altijd voorkomen dat de afspraak voor een Life sessie net niet goed uitkomt, en dan wil je deze verzetten naar een andere datum en of tijdstip. Natuurlijk kan dat, geen probleem. Dat kan je doen door op de link te klikken die in je bevestigings-email zit van de afspraak die je al gemaakt hebt. Dit kan je gratis doen tot 48 uur voor de afspraak zelf. Als je daarna het wilt verzetten of afzeggen, dan zal je wel de kosten moeten betalen voor de RTT sessie.
Aansprakelijkheid
Ik ben niet aansprakelijk voor directe of indirecte schade, op welke manier dan ook verband houdend met of veroorzaakt door de uitvoering van werkzaamheden door mij en het aangeboden programma. Je hebt de keuze om de opgedane kennis tijdens het programma wel of niet toe te passen. Ik ben niet aansprakelijk voor de gevolgen van die keuze of hoe je de kennis toepast, en mogelijke gevolgen of schade voor jou.
Ik ben alleen maar aansprakelijk bij een wettelijke of contractuele toerekenbare tekortkoming.

Disclaimer Therapie

Participatie
Ik (De Cliënt) geef Els Bosma (De Hypnotherapeut) volledige toestemming  om mij te hypnotiseren en om Rapid Transformational Therapy te gebruiken, wetende dat door volledig deel te nemen in het proces en door het luisteren naar mijn persoonlijke opname voor een periode van 21 dagen. Ik heb zelf een belangrijke rol in het behalen van succes.

Garantie
Ik begrijp dat, ondanks het hoge succes percentage van RTT, Els Bosma geen resultaten kan en zal garanderen gezien mijn persoonlijke succes afhankelijk is van vele factoren waar Els Bosma geen controle over heeft, inclusief mijn wens en bereidheid om veranderingen in mijzelf te bewerkstelligen.

Aansprakelijkheid
Ik ga ermee akkoord dat Els Bosma nimmer aansprakelijk is voor mijn psychische of fysieke welzijn tijdens het overeengekomen dienst (nu of in de toekomst), of enige claims die hieruit voortvloeien.

Omvang van de geleverde dienst
Ik begrijp dat Els Bosma geen erkend arts, psycholoog of arts van welke aard dan ook is en dat hypnose geen vervanging is van het advies of werk van een psychiater, psycholoog, psychotherapeut of arts.

Audio-opname(s)
Ik geef Els Bosma volledige toestemming om audio-opnames te maken die mijn stem kunnen bevatten. Ik begrijp dat als een opname wordt gemaakt tijdens of na mijn sessie(s), Els Bosma het volledige auteursrecht behoudt op alle vormen van media die naar aanleiding van de opname(s) kunnen worden geproduceerd en aan mij gedistribueerd.

Verdiepingsproces
Hierbij geef ik Els Bosma toestemming om mijn arm rustig op te tillen, mijn schouder aan te raken of mijn hoofd te schommelen tijdens mijn Rapid Transformational Therapy sessie(s) om het verdiepingsproces te faciliteren.

Vertrouwelijkheid
Door akkoord te gaan met deze voorwaarden, stem ik ermee in dat Els Bosma informatie mag vrijgeven aan een specifiek persoon of instantie als is vastgesteld dat een kind of een oudere het risico loopt op misbruik, of momenteel wordt misbruikt. Of als ik, als cliënt, een gevaar ben voor mijzelf of anderen; of als er een dagvaarding van mijn dossier is aangevraagd.

Ik begrijp ook dat Els Bosma op elk moment aspecten van mijn zaak kan bespreken met collega’s die mijn naam en identiteit volledig vertrouwelijk houden, tenzij ik daar anders toestemming voor heb gegeven.

Terms and conditions

Conditions of sale

Dear Client and / or participant in one of my programs,
In these terms and conditions, we have established what your and my rights and obligations are. If you participate in one of my programs and there is a problem for which you cannot find an answer in these terms and conditions, please contact us. Then we can look for a solution together.
If you see one of these words in this text, formally, this means:

I: E.M. Bosma in my company ElsBosma.com, registered at the Chamber of Commerce under number 70186588, and user of these terms and conditions. You: the natural or legal person who follows a program or enters into another agreement with me.

Program: All forms of information transfer from me to you, both online and offline, in groups or individually. These terms and conditions apply to all offers, quotations and agreements and other legal relationships between you and me.

Offer
I make an offer on the website, via webinars and in other ways. Offers are valid for the time specified in the offer, then no longer.
Agreement
The agreement is concluded when you agree with an offer or quotation if you have paid the agreed fee. I undertake a best-efforts obligation for this agreement, but I do not guarantee that the intended result will be achieved. If necessary, I may have the agreement (partly) executed by a third party. That has never happened before, so it is here purely for emergencies. If it is necessary to change the agreement, I will inform you in time and before the change takes effect.
Programs
You can follow an (online) program with me against payment. Access to the program is personal. So you may not share your login details and materials from the program with others. Live sessions are also only available to you. You can only participate in a program after payment. You must have an internet connection to follow the program. I am not liable for damage or missed program components because you do not have the correct equipment or internet connection. The program can be followed at the moment that you choose.
Reimbursement and payment
Payment must be made before the program starts. I will email you the invoice.

Right of cancellation / Cancellation period
As a customer, you have the right to cancel the agreement without giving any reason within 14 days after registration but before a Life session has taken place in the case of a service or delivery of digital content that is not delivered on a tangible medium, within 14 days after the conclusion of the agreement. You will receive your investment back in full within this period. After a period of 14 days, it is not possible to cancel your participation and thereby receive your investment back. You explicitly agree that article 7: 408 paragraph 1 of the Dutch Civil Code does not apply and that premature termination is not possible.
Cancellation procedure
If you wish to make use of the right to cancel, you must state this within the cooling-off period (but still before the Life session, if applicable) by email to Els Bosma via hello@elsbosma.com. You will receive a confirmation of receipt by e-mail. After this, your access to the course material and the online community will be canceled, and all planned emails related to the training will no longer be sent. After cancellation, you will receive a credit invoice for your own administration, and within fourteen days, you will receive your investment back at the desired bank account number. For questions regarding the cancellation, please contact hello@elsbosma.com.
Move appointment
It can, of course, always happen that the appointment for a Life session does not come outright, and then you want to move it to a different date and / or time. Of course, you can, no problem. You can do this by clicking on the link in your confirmation email of the appointment that you have already made. You can do this for free up to 48 hours before the appointment itself. If you then want to reschedule or cancel, you will have to pay the full amount for the RTT session.
Liability
I am not liable for direct or indirect damage, in whatever way related to or caused by the execution of work by me and the program offered. You have the choice of whether or not to apply the knowledge gained during the program. I am not liable for the consequences of that choice or how you apply the knowledge and possible consequences or damage for you. I am only liable for a legally or contractually attributable shortcoming.

Disclaimer Therapy

Participation

I (The Client) give Els Bosma (The Hypnotherapist) full permission to hypnotise me and to use Rapid Transformational Therapy knowing that by participating fully in the process and by listening to my personalised recording for 21 days I play an important role in my overall success.

Guarantee

I understand that although Rapid Transformational Therapy has an incredibly high success rate, Els Bosma cannot and does not guarantee results since my own personal success depends on many factors that Els Bosma has no control over, including my willingness and desire to affect the changes inside of myself.

Liability

I hereby release Els Bosma from any liability or claims that could be made against her concerning my mental and/or physical well-being during the work that has been outlined and agreed upon (now and in the future) by agreeing to these terms.

Scope of Practice

I understand that Els Bosma is not a licensed physician, psychologist, or medical practitioner of any kind and that hypnosis should not be considered a replacement for the advice and/or services, of a psychiatrist, psychologist, psychotherapist, or doctor.

Audio Recording(s)

I give Els Bosma full permission to make audio recordings that may include my voice. I understand that if a recording (or recordings) are made during or after my session(s) Els Bosma retains full copyright over any forms of media that may be produced and distributed to me.

Deepening Process

I hereby grant permission to Els Bosma to respectfully lift my arm, touch my shoulder, or rock my head during my Rapid Transformational session(s) in order to help facilitate the deepening process.

Confidentiality

By agreeing to these terms, I consent that Els Bosma may release information to a specific individual or agency if it has been determined that a child or elder is at risk of or is currently being abused; if I, as a client, am in imminent danger to myself or others; or if a subpoena of records has been requested.

I also understand that, at any time, Els Bosma may discuss aspects of my case with other colleagues keeping my full name and identity completely confidential unless I have given permission otherwise.
